1. Acceptance of Terms

These Terms & Conditions ("Terms") govern your use of the Instakart mobile application and website (collectively, the "Service"), operated by DevLune (devlune.in). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Definitions

  • "App" means the Instakart Android application available on Google Play (package: in.devlune.villagecart).
  • "Customer" / "You" means any individual who registers and uses the Service to place orders.
  • "Delivery Partner" means the personnel assigned to deliver your order.
  • "Delivery Zone" means the geographic area within a configurable radius from the store's center point, as set by the store administrator.
  • "Store" means the grocery retail establishment fulfilling orders through Instakart.

3. Eligibility

  • You must be at least 18 years of age to use the Service.
  • You must have a valid Indian mobile phone number for OTP verification.
  • Your delivery address must be within the active Delivery Zone to place an order.

4. Account Registration

You register using your phone number via OTP verification powered by Firebase Authentication. You are responsible for maintaining the confidentiality of your account. You agree to provide accurate and current information. We reserve the right to suspend or terminate accounts that violate these Terms.

5. Ordering & Pricing

  • All product prices displayed in the App are in Indian Rupees (₹) and include applicable taxes unless stated otherwise.
  • Prices are set by the Store and may change without prior notice.
  • Product availability is subject to real-time stock. Items may become unavailable after you add them to your cart.
  • A minimum order amount may apply, as configured by the Store administrator.
  • A delivery fee may be charged based on the distance and order value. The exact fee is displayed at checkout before payment.

6. Payment

  • Payments are processed securely through Razorpay. We support UPI, debit cards, credit cards, net banking, and wallets.
  • Cash on Delivery (COD) may be available at the Store's discretion.
  • We do not store your payment card details or UPI ID. Only the Razorpay payment ID and transaction status are retained.
  • By making a payment, you authorize Razorpay to charge the specified amount.

7. Delivery

  • Orders are delivered only within the active Delivery Zone. The zone is verified using your GPS location at the time of order placement.
  • Estimated delivery times are approximate and not guaranteed. Delays may occur due to weather, traffic, or high demand.
  • You must be available at the delivery address to receive the order. If the delivery partner is unable to reach you after reasonable attempts, the order may be marked as undelivered.
  • Delivery partners may contact you via the phone number on your account for delivery coordination.

8. Cancellations

  • You may cancel an order before it has been picked up by the delivery partner.
  • Once the order is out for delivery, cancellation is not possible.
  • Refunds for cancelled orders are processed as per our Refund & Cancellation Policy.

9. Intellectual Property

All content in the App and website — including logos, text, graphics, UI design, and software — is the property of DevLune and is protected by copyright and intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written consent.

10. Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose.
  • Attempt to gain unauthorized access to our systems or other users' accounts.
  • Provide false or misleading information during registration or ordering.
  • Interfere with the proper functioning of the Service.
  • Use automated bots or scrapers to access the Service.
  • Abuse, harass, or threaten delivery partners or store staff.

11. Limitation of Liability

To the maximum extent permitted by applicable law, DevLune and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of profits, data, or goodwill.

Our total liability for any claim arising from the Service shall not exceed the amount paid by you for the order in question.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

Product quality, freshness, and accuracy are the responsibility of the Store. DevLune acts as a technology platform facilitating the transaction between you and the Store.

13. Indemnification

You agree to indemnify and hold harmless DevLune, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any disputes arising from or related to the Service shall be subject to the exclusive jurisdiction of the courts in India.

15. Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated via the App or website. Continued use of the Service after changes constitutes acceptance of the updated Terms.
